Third Lacrosse Player Indicted

A third member of the Duke men’s lacrosse team was indicted by a grand jury Monday afternoon.

Senior David Evans has been charged with first degree forcible rape, first degree sexual offense and first degree kidnapping.

Evans turned himself in at approximately 2 p.m., at the Durham County Detention Facility, where he posted $400,000 bond.

A press conference featuring Evans and his attorney, Joe Chesire, was held in front of the jail. Surrounded by the entire senior class of the lacrosse team, Evans stated that he had passed a polygraph test administered by an FBI agent.

Chesire denied his client’s involvement in any sexual or physical assault, adding that evidence will establish his client’s whereabouts for “every minute” of the evening in question.

Evans was a co-captain of the team and one of three students who leased 610 North Buchanan Blvd., the house where the accuser-a black exotic dancer-was allegedly raped.

Collin Finnerty and Reade Seligmann, two sophomores on the team, were arrested on the same charges April 18.

The indictment comes after a second round of testing partially matched genetic material taken from a false fingernail found in a trash can in the house.

The sample, which was incomplete, matched DNA taken from one of the lacrosse team members who was not Finnerty or Seligmann.

The testing results also matched DNA evidence taken from a vaginal swab to a man who has been named as the alleged victim’s boyfriend.

“There is no conclusive match…that ties any of these young men to this woman who has made these false accusations,” Joseph Cheshire, one of the defense attorneys representing Evans, said at a press conference Friday evening.
